General Terms and Conditions for accommodation contracts (based on the DEHOGA recommendation) of Donau Iller Vermietung 24 GmbH, version 2025.
1 Scope
1.1 These terms and conditions apply to contracts for the letting of hotel rooms for accommodation as well as to all further services and deliveries provided to the customer by the hotel in this connection (accommodation contract). The term “accommodation contract” covers and replaces the following terms: lodging contract, guest contract, hotel contract, hotel room contract.
1.2 Subletting or re-letting the rooms provided, and their use for purposes other than accommodation, require the hotel’s prior consent in text form.
1.3 The customer’s general terms and conditions apply only if this has been expressly agreed in advance.
1.4 “Hotel” within the meaning of these General Terms and Conditions means Donau Iller Vermietung 24 GmbH as landlord. “Room” also includes the apartments and multi-bed rooms let by it.
2 Conclusion of contract, contracting parties, limitation
2.1 The contracting parties are the hotel and the customer. The contract is concluded when the hotel accepts the customer’s request. The hotel is free to confirm the room booking in text form.
2.2 All claims against the hotel generally become time-barred one year after the statutory start of the limitation period. This does not apply to claims for damages or to other claims where the latter are based on an intentional or grossly negligent breach of duty by the hotel.
3 Services, prices, payment, set-off
3.1 The hotel is obliged to keep available the rooms booked by the customer and to provide the agreed services.
3.2 The customer is obliged to pay the hotel’s agreed or applicable prices for the provision of the room and for any further services used. This also applies to services commissioned by the customer directly or through the hotel which are provided by third parties and paid out by the hotel.
3.3 The agreed prices include the taxes and local levies applicable at the time the contract is concluded. If the statutory VAT changes, or if local levies on the subject of the service are newly introduced, changed or abolished after the contract is concluded, prices will be adjusted accordingly.
3.4 The hotel may also change prices if the customer subsequently requests changes to the number of rooms booked, to the hotel’s services or to the length of the guests’ stay, and the hotel agrees to this.
3.5 Hotel invoices without a due date are payable without deduction within ten days of receipt of the invoice. The hotel may at any time require the customer to pay due claims immediately. In the event of the customer’s default in payment, the statutory provisions apply. The hotel reserves the right to prove that higher damages have been incurred.
3.6 On conclusion of the contract, the hotel is entitled to require a reasonable advance payment or security from the customer, for example in the form of a credit card guarantee. The amount of the advance payment and the payment dates may be agreed in the contract in text form. In the event of the customer’s default in payment, the statutory provisions apply.
3.7 In justified cases, for example where the customer is in arrears or the scope of the contract is extended, the hotel is entitled — even after the contract has been concluded and up to the start of the stay — to require an advance payment or security within the meaning of clause 3.6 above, or an increase of the advance payment or security agreed in the contract up to the full agreed remuneration.
3.8 The hotel is further entitled, at the start of and during the stay, to require from the customer a reasonable advance payment or security within the meaning of clause 3.6 above for existing and future claims arising from the contract, insofar as such payment has not already been made pursuant to clauses 3.6 and/or 3.7 above.
3.9 The customer may set off or offset against a claim of the hotel only with an undisputed or legally established claim.
4 Withdrawal by the customer (cancellation) / failure to use the hotel’s services (no-show)
4.1 Withdrawal by the customer from the contract concluded with the hotel is possible only if a right of withdrawal has been expressly agreed in the contract, or if the hotel expressly consents to cancellation of the contract. Agreement of a right of withdrawal and any consent to cancellation of the contract require text form.
4.2 Where a date for cancellation free of charge has been agreed between the hotel and the customer, the customer may withdraw from the contract up to that date without triggering payment or damages claims by the hotel. The customer’s right of withdrawal lapses if it is not exercised vis-à-vis the hotel by the agreed date.
5 Withdrawal by the hotel
5.1 Where it has been agreed that the customer may withdraw from the contract free of charge within a certain period, the hotel is entitled during that period to withdraw from the contract itself if other customers enquire about the contractually booked rooms and the customer, upon enquiry by the hotel with a reasonable deadline, does not waive their right of withdrawal.
5.2 If an advance payment or security agreed or requested pursuant to clauses 3.6 and/or 3.7 is not provided even after a reasonable grace period set by the hotel has expired, the hotel is likewise entitled to withdraw from the contract.
5.3 The hotel is further entitled to withdraw from the contract extraordinarily for objectively justified reasons, in particular if:
- force majeure or other circumstances for which the hotel is not responsible make performance of the contract impossible;
- rooms or premises are booked culpably with misleading or false information or by concealing material facts; material facts may include the identity of the customer, solvency or the purpose of the stay;
- the hotel has reasonable grounds to assume that use of the service may jeopardise smooth business operations, security or the hotel’s public reputation, without this being attributable to the hotel’s sphere of control or organisation;
- the purpose or occasion of the stay is unlawful;
- there is a breach of clause 1.2 above.
5.4 Justified withdrawal by the hotel does not give rise to any claim for damages by the customer.
6 Provision, handover and return of rooms
6.1 The customer is obliged to present valid photo identification (e.g. identity card or passport) at check-in. The hotel is entitled to verify the customer’s identity and to collect and store personal data within the framework of statutory provisions. Should the customer be unable to present photo identification, the hotel reserves the right to cancel the contract or to refuse admission to the room.
6.2 The customer acquires no entitlement to the provision of specific rooms unless this has been expressly agreed.
6.3 Booked rooms are available to the customer from 2:00 p.m. on the agreed day of arrival. The customer has no claim to earlier provision.
6.4 On the agreed day of departure, the rooms must be vacated and made available to the hotel by 10:30 a.m. at the latest. After that, the hotel may charge 50 % of the full room rate (list price) for use beyond the contract until 2:00 p.m., and 100 % from 4:00 p.m.
7 Non-smoking hotel / calling out the fire brigade in the event of fire
Smoking is prohibited throughout the hotel. If guests nevertheless smoke in the room, we charge the guest EUR 200.00 towards cleaning costs. If the room cannot be let the following day because of a strong smell of smoke, an additional night will be invoiced at the list price. All premises and guest rooms are connected to a fire alarm control panel via smoke detectors. In the event of a fire alarm caused by the guest’s fault, all resulting costs directly connected with it — such as the deployment of the fire brigade or the subsequent costs of restoring operations — are to be borne by the guest alone.
8 Pets
Dogs are permitted on request for a daily cleaning fee of EUR 10.00. All damage caused by the animal is to be borne by its owner.
9 Liability of the hotel
9.1 The hotel is liable for damage attributable to it arising from injury to life, body or health. It is further liable for other damage based on an intentional or grossly negligent breach of duty by the hotel, or on an intentional or negligent breach of duties typical of the contract. A breach of duty by the hotel is equivalent to a breach by a legal representative or vicarious agent. Should disruptions or defects occur in the hotel’s services, the hotel will endeavour to remedy them upon becoming aware of them or upon immediate complaint by the customer. The customer is obliged to contribute what is reasonable in order to remedy the disruption and to keep any damage to a minimum.
10 Agreement on the use of internet access
10.1 The owner operates internet access via Wi-Fi in the hotel. The owner permits the guest access to the internet for the duration of their stay at the hotel. Shared use is a service of the hotel and may be revoked at any time. By registering in our system, the guest agrees to the terms of use in clause 10 et seq. The guest has no right to permit third parties to use the internet via Wi-Fi. Responsibility for the transmitted data remains with the recipient of the password. The owner accepts no warranty for the actual availability or reliability of the internet access for any purpose. The owner is entitled at any time to discontinue operation of the internet access in whole, in part or temporarily, to admit further co-users, and to restrict or exclude the guest’s access in whole, in part or temporarily. In particular, the owner reserves the right to block access to certain sites or services at their own discretion and at any time. The co-user alone is responsible for creating all technical and organisational prerequisites for using the internet.
10.2 Use takes place by entering a user name and password. The access data (user name and password) is intended solely for personal use and for the duration of the stay at the hotel. It must under no circumstances be passed on to third parties. The guest undertakes to keep their access data secret. The owner has the right to change the access code at any time.
10.3 The guest is advised that Wi-Fi only enables access to the internet. Virus protection and a firewall are not provided. Data traffic established using the internet is unencrypted. The data may therefore possibly be viewed by third parties. The owner expressly points out that there is a risk of malware reaching the end device when using the internet access. Use of the internet is at the guest’s own risk and peril. The owner accepts no liability for damage to the guest’s computer arising from use of the internet access, unless the damage was caused by the owner intentionally or through gross negligence.
10.4 The guest is responsible for the data transmitted via the internet, for the chargeable services used through it and for the legal transactions entered into. If the guest visits chargeable websites or enters into obligations, the resulting costs are to be borne by the guest.
10.5 Pursuant to § 113a TKG (BGBl), the operator is obliged to log all usage data and store it for 6 months. Once the retention obligation has expired, all usage data is deleted.
10.6 The co-user indemnifies the hotelier against all damage and third-party claims based on unlawful use of the Wi-Fi by the co-user and/or on a breach of the present agreements; this also extends to costs and expenses connected with such claims or their defence. If the guest recognises, or must recognise, that such an infringement exists or is imminent, they shall notify the hotel of this circumstance.
11 Final provisions
11.1 Amendments and additions to the contract, to the acceptance of the request or to these General Terms and Conditions require text form. Unilateral amendments or additions by the customer are invalid.
11.2 In commercial dealings, the place of performance and payment as well as the exclusive place of jurisdiction — including for disputes concerning cheques and bills of exchange — is the location of the hotel. Where a contracting party fulfils the requirement of § 38(2) ZPO and has no general place of jurisdiction in Germany, the registered seat of the hotel shall be deemed the place of jurisdiction.
11.3 German law applies. The application of the UN Convention on Contracts for the International Sale of Goods and of conflict-of-law rules is excluded.
11.4 Should individual provisions of these General Terms and Conditions be or become invalid or void, this shall not affect the validity of the remaining provisions. In all other respects, the statutory provisions apply.
